Providing personal data as well as consent to their processing are completely voluntary. All personal data provided to us are processed only to the extent and for the purpose for which you have given your consent. If, however, you decide not to provide us with the data necessary to process the order and you do not consent to their processing, unfortunately we will not be able to process your order.

Please remember that you have the right to update or completely delete your personal data at any time. You can do it yourself or with our help, which we will gladly provide.

II. Personal data protection system

The PDA applied technical and organisational measures to ensure the protection of processed data in accordance with the requirements set out in the applicable provisions on the protection of personal data. In particular, the documents taken into account include: the regulation of the Minister of the Interior and Administration of April 29, 2004 on the documentation of the personal data processing and technological and organisational conditions which shall be met by devices and IT systems used for the personal data processing (Journal No. 100, item 1024); the guidelines of the Inspector General for Personal Data Protection; the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

The most important elements of the applied personal data protection system include:

  1. An SSL certificate that guarantees that communication between your computer and Pomona.pl is encrypted with a 256-bit key.
  2. We collect and process only the necessary personal data for the shortest possible time, and you must provide separate consent for each activity not related to the implementation of the sale and purchase agreement.
  3. Your personal data can be accessed only by authorised people trained in the field of personal data protection, who guarantee data security.
  4. The Pomona.pl IT system and internal company procedures meet all standards of personal data protection.

Therefore, the PDA fulfilled all the obligations provided for by law in the field of personal data protection.



III. Personal data, purpose and duration of storage

A. Registration

During registration, please provide the data necessary to create an account at Pomona.pl, thanks to which you do not have to waste time refilling the entire order form with each subsequent purchase. By registering, you save time and money, because registered customers participate in the loyalty program and receive discounts based on previously made purchases.

After logging in, a registered customer can also verify the status of the placed order and the history of made purchases. A registered and logged-in customer may at any time independently correct, complete or delete data from Pomona.pl.

During registration, you are asked to provide:

  1. your full name – necessary for us to later issue a sales document and address the package;
  2. your address (street, house number/or house and apartment number, zip code and city) – necessary for us to later address the package;
  3. your e-mail – necessary for logging in and communication related to the use of Pomona.pl;
  4. your phone number – necessary in the case of choosing some delivery methods (required by carriers)

The data is stored for a period of 5 years from the last login.


B. Placing an order

When placing an order, please provide us with the data necessary to process the order, which in the case of registered and logged in customers are partially collected automatically from the data provided during registration.

When placing an order, please provide:

  1. your full name or name of your company/institution – necessary to issue a sales document and address the package;
  2. your address (street, house number/or house and apartment number, zip code and city) – necessary to address the package;
  3. your e-mail – necessary for communication related to the processing of the order;
  4. your phone number – necessary in the case of choosing some delivery methods (required by carriers).

If, when placing an order, the Customer chooses a delivery to an address other than the address indicated during registration or placing an order, we ask to additionally provide:

  1. your full name or name of your company/institution – necessary for us to address the package;
  2. your address (street, house number/or house and apartment number, zip code and city) – necessary to address the package;
  3. phone number of the recipient of the package – necessary in the case of choosing some delivery methods (required by carriers).

 

If, when placing an order, the Customer chooses to have their sales document issued for data other than those indicated during registration or placing an order, we ask to provide:

  1. your full name or name of your company/institution – necessary to issue a sales document;
  2. your address (street, house number/or house and apartment number, zip code and city) – necessary issue a sales document;

The data provided when placing the order are processed by pomona.pl.

If you use an external payment system, all data provided after switching to the payment operator’s website remain registered only in its database and are in no way available or stored by Pomona.pl.

C. Marketing

If you subscribe to the newsletter and agree to receive it during the registration or ordering process, please only provide your e-mail address, to which commercial information from Pomona.pl will be sent. You can unsubscribe at any time by logging into your Pomona account .pl or by clicking the unsubscribe link in the footer of each newsletter.

D. Correspondence

In the event that we are provided with personal data that is not necessary for us to process your order or fulfil a legal obligation, e.g. in correspondence with us, in the withdrawal, warranty or guarantee forms, these data will be immediately deleted or made anonymous and will not be processed.

Therefore, please do not provide us with information and personal data that we do not explicitly ask for and that are not relevant to process the order or fulfil legal obligation.

IV. Cookies - your personal data that is collected automatically upon entering Pomona.pl

Cookie files are information technology data, in particular text files, which are stored on the Pomona.pl Customer’s end device.

Pomona.pl uses two basic types of cookie files: session cookies and persistent cookies. Session cookies are temporary files that are stored on the Customer’s end device until logging out, leaving the website or turning off the software (web browser). “Persistent” cookies are stored on the Customer’s end device for the time specified in the cookie file parameters or until they are deleted by the Customer.

Pomona.pl uses the following types of cookie files:

  1. “necessary” cookie files, enabling the use of services available on Pomona.pl; e.g. authentication cookies used for services that require authentication;
  2. cookie files used to ensure security, e.g. used to detect fraud in the field of authentication within Pomona.pl;
  3. “performance” cookies, enabling the collection of information on the use of Pomona.pl websites;
  4. “functional” cookie files, enabling “remembering” the settings selected by the Customer and personalisation of the Pomona.pl interface;
  5. “advertising” cookie files, enabling the delivery of advertising content, which is more tailored to the interests of the Customer.

In numerous cases, the software used for browsing websites (web browser) allows cookies to be stored by default.

If you do not agree to the placement of cookies on your device, you can block their placement by a specific configuration of your web browser. Information on how to do this can be found in the help files of your web browser. Unfortunately, if you block cookie files from Pomona.pl, we cannot guarantee its correct operation.

If you agree to place cookie files on your device, but after completing your visit to Pomona.pl, you would like to delete them, you can do it without risk and information on how to do this can be found in the help files of your web browser.

A. Pomona.pl (server)

The information technology system used by Pomona.pl automatically collects log data related to the device you use when connecting to Pomona.pl. These data are collected only for statistical purposes and concern: the type of device, operating system, type of web browser, screen resolution, colour depth, IP, Internet service provider, or the Pomona.pl entry address and are used only in the Pomona.pl optimisation process. in order to ensure the greatest possible comfort of use.

These data are never combined with the data referred to in Part III and are only material for statistical analysis and mechanisms for correcting system errors.

The data is processed for 24 months from the last activity.

B. Pomona.pl (cookies)

Pomona.pl uses the technology of cookies, or text files placed on your device, in order to enable Pomona.pl to recognise you and adapt Pomona.pl to your needs.

Pomona.pl uses cookies to:

  1. remember logging in (the session lasts 30 minutes from the last activity, after which the cookie is deleted);
  2. remember the contents of your basket (the session lasts 30 minutes from the last activity, after which the cookie is deleted);
  3. remember your Pomona.pl display preferences (the session lasts 30 minutes from the last activity, after which the cookie is deleted);
  4. create statistics and audience reports concerning the functioning of Pomona.pl; (the session lasts 30 minutes from the last activity, after which the cookie is deleted);
  5. personalise the appearance of Pomona.pl by displaying products that the store’s algorithm will indicate as interesting for you based on the products you bought, placed in the basket, searched in the store, as well as their authors, producers, category – in a word similar products, but never combined directly with your personal data. Google Analytics uses the technology of “cookies”, or text files placed on your device, in order to enable Pomona.pl to analsze the sources of traffic and the manner in which visitors use it.

Google may also transfer this information to third parties if it is required to do so by law or if these people process such information on behalf of Google.

Google AdWords / Google Ads uses the “cookies” technology, or text files placed on your device, in order to enable the assessment of the correctness and effectiveness of advertising activities using the AdWords / Ads network by Pomona.pl.

Google collects on its servers data obtained from the placement of cookies on devices and uses this information to create reports and provide other services related to traffic and Internet use.

Google may also transfer this information to third parties if it is required to do so by law or if these people process such information on behalf of Google.

These data are never combined with the data referred to in Part III and are only material for statistical analysis and mechanisms for correcting system errors.

E. Cookies from partners’ servers

Pomona.pl uses scripts and software components provided and located on the servers of its business partners. Such cookies may contain data necessary for the partner to provide the service to Pomona.pl or comprising data other than those specified in the privacy policy.

Pomona.pl selects its business partners very carefully, however, it is not responsible for their cookie policy. Therefore, we recommend that you verify each of our partners on your own and decide for yourself whether you want to accept their cookies.

V. Privacy protection policy of Pomona.pl partners

Pomona.pl very carefully selects its business partners and also carefully verifies links to other websites posted on Pomona.pl. However, Pomona.pl, is not responsible for the standard and privacy policy applied by the owners, operators or administrators of these websites. Therefore, we recommend that you verify each of our partners on your own and decide for yourself whether you want to entrust them with your personal data.


VI. Transfer of your personal data

In special situations where the applicable law requires the Personal Data Administrator to provide the collected data to state authorities, Pomona.pl will provide such data.

Except for these situations, your personal data will be transferred to specific entities only and in connection with the need to perform the contractual or legal obligation of the Personal Data Administrator to the extent permitted by law on the basis of separate entrustment agreements. The categories of entities that may receive your data include: advertising agencies, banks, accounting and bookkeeping offices, information technology service providers, courier companies, logistics companies, payment institutions, carriers.

In the event of such transfer, the Personal Data Administrator concludes appropriate entrustment agreements with these entities, guaranteeing the highest standard of protection and maintaining the confidentiality and security of personal data, as well as their use only for the purpose of implementing the contractual or legal obligation of the Personal Data Administrator.

VII. Change of the Pomona.pl privacy policy

Pomona.pl reserves the right to change the privacy policy, if required by applicable law, the technological conditions of Pomona.pl operation change or the change introduces a higher standard than the minimum required by law.

Pomona.pl will notify you about such a change by e-mail (to the e-mail address provided during registration).

VIII. Your rights

In accordance with applicable regulations, you have the right to:

  1. deny or limit the processing of your personal data;
  2. object to the processing of your personal data;
  3. access your personal data;
  4. correct or delete your personal data;
  5. transfer your personal data;
  6. withdraw your consent to the processing of your personal data;
  7. lay a complaint to the supervisory body – the President of the Personal Data Protection Office.

 

These rights are inalienable and may not be restricted. We are always happy to provide you with help and information, and you can exercise some of the above-mentioned rights yourself.
